Terms of Service

1. Overview

These Terms of Service ("Terms") govern access to and use of WoWPrep Academy, including the website, app, learning tools, Free Tier, Plus Tier, Season Passes, Practice Tests, FairMode, parent linking, support, and related services.

WoWPrep Academy is a trading brand operated under the ASIC-registered business name WOWPREP ("WoWPrep", "WoWPrep Academy", "we", "us", or "our"). The registered business name holder is recorded on the public ASIC Business Names Register.

By creating an account, using the service, starting a free or paid plan, accepting a parent link, or purchasing access, the user agrees to these Terms and our Privacy Policy.

If a user does not agree, they must not use WoWPrep.

2. Eligibility and accounts

Users must provide accurate account information and use WoWPrep only for lawful educational purposes.

If a user is under 18, they must have permission from a parent or legal guardian. A parent or guardian involved in creating, paying for, linking to, or managing a child account accepts these Terms on their own behalf and, where permitted by law, on behalf of the child.

Users are responsible for keeping account details secure. Users must not share passwords, sell or transfer accounts, create multiple accounts to bypass limits, impersonate others, or allow someone else to complete practice, tests, or mocks for them.

We may require email verification, password reset, additional confirmation, or support verification before allowing sensitive account actions.

3. Licence to use WoWPrep

Subject to these Terms, we grant users a limited, personal, revocable, non-exclusive, non-transferable licence to access and use WoWPrep for personal educational exam preparation.

Users must not copy, scrape, reproduce, publish, sell, resell, reverse engineer, bypass paywalls, misuse, or create derivative works from WoWPrep content or software without written permission.

4. Educational service only

WoWPrep provides educational preparation tools. It is not an official exam provider, university, school, government agency, admission authority, or official score calculator.

WoWPrep does not guarantee any KUAT score, percentage improvement, admission to Kuwait University, placement in any major, passing result, official exam outcome, or that practice questions will match official exam questions.

Any scores, insights, estimates, readiness indicators, or progress dashboards are educational guidance only.

5. KUAT and institution non-affiliation

WoWPrep Academy is not affiliated with, endorsed by, authorised by, sponsored by, or partnered with Kuwait University.

KUAT is referenced only to describe the exam that WoWPrep helps students prepare for. WoWPrep does not claim ownership of Kuwait University trademarks, names, logos, official questions, official exam papers, or official curriculum documents.

Users must not represent that WoWPrep is an official Kuwait University product or that use of WoWPrep creates any relationship with Kuwait University.

6. Plans, pricing, and payment

WoWPrep may offer Free Tier, Plus Tier, Season Passes, subject bundles, promo codes, mock credits, or other entitlements. The exact price, currency, duration, subjects, features, credits, and access rules are those shown at checkout or on the applicable plan page when purchased.

WoWPrep's Kuwait launch commercial model is a one-time fixed-term Season Pass in KWD. There is no automatic renewal. Subscription or recurring billing is not used unless a future checkout page expressly states otherwise and updated terms apply.

Unless stated otherwise:

  1. a Season Pass gives access for the period shown at checkout;
  2. paid access starts when payment is confirmed or when a queued pass begins;
  3. paid access ends when the pass expires;
  4. if a user purchases an additional Season Pass while an existing pass is active, the new pass is queued and begins when the current pass ends;
  5. passes are not merged into a single pass unless the checkout page expressly says otherwise;
  6. unused features, credits, or days may expire at the end of the pass;
  7. prices may change for future purchases;
  8. price changes do not affect an already purchased pass unless required by law or clearly stated.

Payments are processed by MyFatoorah or another approved payment provider. Payment provider terms, fees, verification checks, fraud checks, settlement rules, refund rails, chargeback rules, currency conversion, and payment method availability may apply.

WoWPrep does not collect, store, or process full payment card numbers or card verification codes.

7. Refund Policy

Paid Season Passes are non-refundable.

By purchasing a Season Pass, you acknowledge that you receive immediate access to digital exam preparation content upon payment confirmation, and you accept that the pass is non-refundable.

WoWPrep does not issue refunds for:

  1. change of mind
  2. non-use of the service after purchase
  3. expected exam outcomes or actual exam results
  4. account closure initiated by the user
  5. dissatisfaction with content, results, or progress
  6. completion of the pass term without exam success
  7. circumstances within the user's control, including device issues, internet connection, account sharing, or unauthorised account use
  8. forgetting to use the service or losing track of the pass term

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, refund right, or mandatory protection that cannot lawfully be excluded under applicable consumer protection law, including the Australian Consumer Law where it applies and any mandatory Kuwait consumer protection rights where they apply.

If you believe you have a refund right under applicable consumer protection law, contact us at support@wowprepacademy.com with your account email, payment date, transaction reference if available, and a description of the issue. We will review the request against the applicable legal framework.

Any refund issued under applicable consumer protection law will be processed through the original payment provider where practical. Timing depends on the payment provider, bank, payment network, KNET, card scheme, or app store rules.

8. Caps, quotas, and credits

Free and paid access may have limits on questions shown, practice sessions, stories, mock tests, FairMode attempts, credits, insights, history, parent dashboard features, support features, downloads, and account actions.

Quotas may be counted when a question is shown, not when answered. This prevents users from bypassing caps by opening questions without submitting.

We may adjust caps, credits, features, or plan limits for future plans or future billing periods. We will not intentionally remove already purchased core access during an active paid pass except where needed for security, legal compliance, technical emergency, misuse, provider changes, or product changes allowed by these Terms.

9. FairMode and timed attempts

FairMode and other timed attempts are practice tools and may include exam-like rules, such as desktop or laptop access, stable internet requirements, no resume after disconnection, one credit consumed at start, fullscreen requirements where supported, tab-switch or focus-loss logging, copy/paste attempt logging, fixed navigation rules, integrity labels, and attempt down-weighting where integrity signals are triggered.

By starting FairMode or a timed attempt, the user accepts these rules.

Integrity controls are best-effort signals for educational trust and product fairness. They are not official proctoring and may not detect every type of cheating or misuse.

10. User Content and learning data

Users retain any rights they have in content or information they submit. Users grant WoWPrep a worldwide, non-exclusive, royalty-free licence to use, host, store, reproduce, process, analyse, display, and create derived data from submitted information as needed to provide the service, save progress, score attempts, generate insights, provide support, process payments, secure the platform, improve content, create anonymised or aggregated statistics, comply with law, and enforce these Terms.

Users must not submit content that is unlawful, abusive, infringing, misleading, harmful, or contains unnecessary sensitive information.

11. Intellectual property

All WoWPrep content and intellectual property belongs to WoWPrep or its licensors. This includes software, user interface, product design, learning engine logic, questions, answer options, explanations, stories, diagrams, tables, learning paths, insights structure, scoring logic, taxonomy, brand assets, databases, analytics structures, and documentation.

Users may use WoWPrep content only inside the service for personal exam preparation. Users must not copy, reproduce, distribute, publish, sell, license, scrape, export, download in bulk, or create derivative works from WoWPrep content without written permission.

12. Acceptable use

Users must not:

  1. scrape, crawl, spider, or bulk download content;
  2. use bots, scripts, automation, or browser automation to access questions;
  3. share, sell, publish, or redistribute questions or explanations;
  4. upload malware;
  5. attack, probe, scan, or test the service without permission;
  6. bypass security controls, paywalls, or entitlements;
  7. manipulate scores or integrity signals;
  8. use another person's account;
  9. let someone else complete attempts for them;
  10. create multiple accounts to gain extra free access;
  11. reverse engineer the platform;
  12. copy content into tutoring packs, social media, websites, documents, AI tools, or other services;
  13. harass, abuse, threaten, or impersonate others;
  14. submit false payment, refund, support, or identity information;
  15. violate applicable law;
  16. interfere with service availability;
  17. use WoWPrep for commercial tutoring, school, institution, or group training without written permission.

13. Parent accounts and child accounts

Parents may link to child accounts where the service supports it. Parent linking may require child confirmation, parent confirmation, or other verification.

Parent dashboard access is limited to high-level progress information. Parents must not misuse child progress information, share child account access, complete practice or mocks on behalf of the child, or use the dashboard for unlawful or harmful purposes.

Students and parents may request unlinking. Once unlinked, dashboard access ends, subject to legal, payment, security, support, and dispute records.

14. Suspension and termination

We may suspend, restrict, or terminate access without refund where permitted by law if a user breaches these Terms, misuses the service, shares accounts, scrapes or copies content, fails payment, reverses payment, triggers fraud concerns, creates security risk, abuses support or other users, manipulates attempts or integrity controls, creates legal or operational risk, or where required by law, payment provider, app store, platform, or authority.

We may preserve records necessary to investigate and enforce breaches, including payment, audit, support, security, and integrity records.

Users may request account closure by contacting support@wowprepacademy.com. Account closure may result in loss of learning history, saved progress, scores, parent links, remaining access, credits, paid features, support history, and personalisation. Account closure does not create a refund right except where required by applicable consumer protection law.

15. Support and content issues

Users may contact support for login, payment, linking, content issues, FairMode, deletion, or other matters. We aim to respond within a reasonable time but do not guarantee a specific response time unless required by law or separately stated.

When a user reports a content issue, the user permits us to review the relevant question, attempt reference, support message, and technical details needed to investigate. We may correct, remove, revise, or leave unchanged any content at our discretion.

16. Service availability and changes

WoWPrep is provided on a reasonable-efforts basis. We do not guarantee uninterrupted, error-free, or always-available service.

The service may be affected by internet failures, device issues, hosting outages, payment provider outages, app store issues, bugs, maintenance, security incidents, third-party provider failures, regulatory changes, emergency changes, or circumstances beyond our reasonable control.

We may modify, suspend, replace, limit, or discontinue features where reasonably necessary, including for security, compliance, reliability, product improvement, vendor changes, or commercial reasons.

For paid users, we will make reasonable efforts not to materially reduce core paid access during an active paid term unless necessary for security, legal compliance, misuse prevention, provider changes, or circumstances beyond our control.

17. Third-party services

Some parts of WoWPrep depend on third-party services, including hosting, authentication, payments, email, analytics, error monitoring, advertising, app stores, DNS, security, and support.

We are not responsible for third-party services except to the extent required by law. Third-party providers may have their own terms, privacy policies, outages, fees, limits, and account requirements.

18. Disclaimers

To the maximum extent permitted by law, WoWPrep is provided "as is" and "as available". We disclaim all warranties, representations, and conditions not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, uninterrupted access, non-infringement, and suitability for any specific exam outcome.

We do not warrant that content is error-free, every explanation is perfect, every topic is covered, the platform will always be available, all bugs will be fixed, all integrity breaches will be detected, all data loss can be prevented, a user's device or internet connection will work, official KUAT content or rules will remain unchanged, or user results will improve.

Nothing in these Terms excludes any warranty, guarantee, condition, or right that cannot lawfully be excluded.

19. Limitation of liability

To the maximum extent permitted by law, WoWPrep is not liable for indirect, incidental, special, consequential, punitive, or exemplary loss or damage, including loss of opportunity, loss of admission, loss of expected score, loss of data, loss of goodwill, loss of profits, business interruption, emotional distress, or exam-day consequences.

To the maximum extent permitted by law, WoWPrep's total aggregate liability arising out of or relating to the service, these Terms, paid access, or a user account is limited to the greater of:

  1. the amount the user paid WoWPrep for the service in the 12 months before the event giving rise to the claim; or
  2. AUD $100.

Where Australian Consumer Law or another mandatory law applies and liability cannot be excluded, our liability is limited, where permitted, to resupplying the service, paying the cost of resupplying the service, or refunding the affected portion of the service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

20. Indemnity

To the maximum extent permitted by law, each user agrees to indemnify WoWPrep, its operator, contractors, service providers, licensors, and representatives from claims, losses, damages, liabilities, costs, and expenses arising from the user's breach of these Terms, misuse of the service, account sharing, scraping or copying of content, unlawful conduct, fraud or payment misuse, intellectual property infringement, attempts to bypass platform security or entitlements, submitted content, or use of the user's account by someone else where the user failed to keep it secure.

This indemnity does not apply to the extent caused by WoWPrep's fraud, wilful misconduct, or liability that cannot be excluded by law.

21. Privacy and cookies

Use of WoWPrep is subject to our Privacy Policy. By using WoWPrep, each user acknowledges that personal information may be collected, used, stored, disclosed, transferred, retained, deleted, or anonymised as described in the Privacy Policy.

WoWPrep may use cookies, pixels, local storage, and similar technologies. Essential cookies are required for login, security, routing, checkout, CSRF protection, and remembering privacy choices. Analytics and marketing cookies may be used where enabled and consented where required. Users can control non-essential cookies through the cookie banner, browser settings, and provider opt-out tools where available.

22. Communications

We may send service communications, including account verification, password resets, security alerts, support replies, payment confirmations, expiry reminders, policy updates, educational reminders, parent-linking notices, and FairMode or mock completion notices where enabled.

We may send marketing communications only where permitted by law. Marketing messages identify WoWPrep and include an unsubscribe method where required.

23. Changes to these Terms

We may change these Terms from time to time. Updated Terms take effect on the effective date shown, unless a later date is stated.

For material changes, we may email users, show an in-app notice, require re-acceptance, notify at checkout, or stop access if the user does not accept updated Terms. Continued use after updated Terms take effect means the user accepts the updated Terms.

24. Assignment and business transfer

Users may not assign, transfer, or sublicense accounts or rights under these Terms without our written permission.

We may assign, transfer, novate, subcontract, or delegate these Terms, accounts, data, rights, and obligations to a company we form, a related business, a purchaser, a successor operator, a merger or restructuring entity, a service provider where permitted, or another entity as part of a business sale, asset sale, reorganisation, incorporation, or transfer.

If we transfer the service to a different legal operator, we will provide notice where required by law.

25. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia, except where mandatory local laws apply and cannot be excluded.

Users and WoWPrep submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

Kuwait users retain any mandatory consumer protection, privacy, payment, electronic commerce, or other rights under Kuwait law that cannot legally be excluded or reduced by these Terms.

Before starting legal proceedings, each party must first try to resolve the dispute by contacting the other party and allowing a reasonable time for response, unless urgent relief is required.

Nothing prevents either party from seeking urgent injunctive or equitable relief to protect intellectual property, confidential information, platform security, payment integrity, or user safety.

26. General terms

If any part of these Terms is invalid, illegal, or unenforceable, that part will be read down or severed to the minimum extent necessary, and the remaining Terms will continue in effect.

A failure or delay by WoWPrep to enforce any right does not waive that right. A waiver must be written and signed by us to be effective.

These Terms, the Privacy Policy, checkout terms, and plan-specific terms presented at purchase form the entire agreement between the user and WoWPrep for consumer use of the service.

If there is a conflict, mandatory law prevails first, then specific checkout terms, then the Privacy Policy for privacy matters, then these Terms for general service use.
